Die Midnightbazar UG, mit Sitz: Ligsalzstrasse 12, 80339 München ist Veranstalter von Gewinnspielen auf den unterschiedlichen Plattformen: Craftbeer Oktoberfest Instagram & Facebook. Für Gewinnspiele über diese Facebook- und Instagram-Seiten gilt zudem: Das Gewinnspiel steht in keiner Verbindung zu Facebook bzw. Instagram und wird in keiner Weise von Facebook bzw. Instagram gesponsert, unterstützt oder organisiert.

Für die Teilnahme an Gewinnspielen von Midnightbazar UG gelten die vorliegenden Teilnahmebedingungen sowie Gewinnspielregeln für einzelne Gewinnspiele, in welchem Ablauf und Zeitraum des Gewinnspiels, die Gewinne, sowie die Ermittlung und Bekanntgabe der Gewinner festgelegt werden. Sachpreise können nicht in bar ausgezahlt werden und sind vom Umtausch ausgeschlossen. Mit ihrer Teilnahme am Wettbewerb akzeptieren die Teilnehmer:innen die Teilnahmebedingungen und die Gewinnspielregeln.

Die Teilnahme an Gewinnspielen ist kostenlos und nicht an den Erwerb von Dienstleistungen von Midnightbazar UG gebunden. 

Die Gewinner:innen werden von Midnightbazar UG spätestens 12 Stunden vor Beginn der Veranstaltung per Direktnachricht über Instagram- oder Facebook benachrichtigt. Für alle Gewinnspiele gilt, dass die Gewinner:innen i.d.R. innerhalb sieben Tage nach der Verlosung eine Benachrichtigung erhalten. Eine mögliche Anreise und/oder dadurch entstehende Übernachtungskosten werden nicht übernommen und müssen eigenständig organisiert werden. Weiter ist zu beachten, dass die Verfügbarkeit der Teilnehmer:innen an dem jeweiligen Veranstaltungstag und Uhrzeit von den Teilnehmer:innen selbständig gewährleistet werden muss. 

Teilnahmeberechtigt sind alle Personen ab 18 Jahren. Eine Teilnahme von Kindern oder Jugendlichen ist nur zulässig, soweit sich die Erziehungsberechtigten mit der Teilnahme am Gewinnspiel vor Teilnahme einverstanden erklären; im Gewinnfall erfolgt eine Gewinnausgabe an die Erziehungsberechtigten. Mitarbeiter:innen von Midnightbazar UG sowie Angehörige betreffender Mitarbeiter:innen sind von der Teilnahme ausgeschlossen. Jede:r Teilnehmer:in darf nur einmal an einem einzelnen Gewinnspiel teilnehmen.

Ein Verstoß gegen die Teilnahmebedingungen, einschließlich der Spielregeln für das betreffende Gewinnspiel, berechtigt Midnightbazar UG, den/die jeweilige:n Teilnehmer:in von der Teilnahme auszuschließen. Dies gilt insbesondere, wenn ein:e Teilnehmer:in im Rahmen der Anmeldung zum Gewinnspiel falsche Angaben macht oder versucht, manipulativ auf den Spielverlauf oder die Voraussetzungen für den Erhalt eines Gewinns einzuwirken. Handelt es sich bei dem/der ausgeschlossenen Teilnehmer:in um eine:n Gewinner:in, kann der Gewinn nachträglich aberkannt werden. Der Anspruch auf den Gewinn verfällt ebenfalls, wenn die Übermittlung des Gewinns nicht innerhalb von sechs Wochen nach der ersten Benachrichtigung über den Gewinn aus Gründen, die in der Person des Gewinners liegen, erfolgen kann; in diesem Fall wird ein:e Ersatzgewinner:in ermittelt. Die Teilnehmer verpflichten sich, keine rechtswidrigen Inhalte zu teilen.

Midnightbazar UG behält sich das Recht vor, das Gewinnspiel jederzeit, auch ohne Einhaltung von Fristen, ganz oder teilweise vorzeitig zu beenden oder in seinem Verlauf abzuändern, sofern es aus technischen (z. B. Computervirus, Manipulation von oder Fehler in Software/Hardware) oder rechtlichen Gründen nicht möglich ist, eine ordnungsgemäße Durchführung des Gewinnspiels zu gewährleisten.

Midnightbazar behält sich das Recht vor, die Daten des Gewinners oder der Gewinnerin an Dritte weiterzugeben, sollte es für die Zustellung und Einlösung des Gewinns vonnöten sein. Die Teilnehmer:innen erklären sich mit der Nutzung ihrer Daten zu diesem Zweck einverstanden.

For raffles on the above mentioned Facebook and Instagram pages the following applies: The raffle is in no way connected to Facebook or Instagram and is in no way sponsored, supported or organized by Facebook or Instagram.

For participation in the raffles of Midnightbazar UG, the present conditions of participation as well as rules for individual raffle apply, in which the course and period of the raffle, the prizes, as well as the determination and announcement of the winners are determined. Prizes cannot be paid out in cash and are excluded from exchange. With the participation in the competition participants accept the conditions of participation and the rules of the raffle.

Participation in the raffle is free of charge and not tied to the purchase of services from Midnightbazar UG.

The winners will be notified by Midnightbazar UG at least 12 hours before the start of the event via Instagram or Facebook.

For all raffles, the winners will usually receive a notification within seven days after the draw. A possible journey and / or resulting accommodation costs are not covered and must be organized independently. Furthermore, it should be noted that the availability of the participants on the respective event day and time must be ensured by the participants themselves.

All persons 18 years and older are eligible to participate. Participation under 18 is only permitted if their legal guardians agree to their participation in the competition prior to participation; in the event of a win, the prize will be awarded to the legal guardian. Employees of Midnightbazar UG and relatives of such employees are excluded from participation. Each participant may only take part once per raffle.

A violation of the conditions of participation, including the rules of the game for the respective raffle entitles Midnightbazar UG to exclude the respective person from participation.

This applies in particular if a participant makes false statements in the context of the registration for the competition or attempts to manipulate the course of the game or the conditions for receiving a prize. If the excluded participant is a winner, the prize can be subsequently revoked. The claim to the prize shall also be forfeited if the prize cannot be transmitted within six weeks of the first notification of the prize for reasons relating to the person of the winner; in this case, a replacement winner shall be determined. Participants agree not to share any illegal content.

Midnightbazar UG reserves the right to prematurely terminate the competition in whole or in part at any time, even without observing deadlines, or to change its course if it is not possible for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons to ensure proper implementation of the competition.

Midnightbazar reserves the right to pass on the data of the winner to third parties, should it be necessary for the delivery and redemption of the prize. Participants agree to the use of their data for this purpose.
